贵客注意事项 一、 请详阅本机票中有关贵客权益之各项条款内容。 二、 若贵客行程不适用于华沙公约之规定及限制时,则适用台湾地区之「民用航空法」及「航空客货损害赔偿办法」之规定,其赔偿额之标准为:对每一乘客死亡者,新台币三百万元;重伤者,新台币一百五十万元;非死亡或重伤者,按实际损害计算,但最高不得超过新台币一百五十万元。对登记之行李,按实际损害计算,但每公斤最高不得超过新台币一千元,随身行李,按实际损害计算,但每一乘客最高不得超过新台币二万元。如法规经修订,则依修订后之规定为准。 三、 本机票必须按票联之顺序使用,否则航空公司将拒绝贵客使用。 四、 持用特种机票旅客,请向航空公司或旅行社洽询有关该特种票之规定及限制。 五、 本机票票联内所列时间为班机起飞时间。为使贵客能于足够时间内完成登机报到手续,务请至迟于班机起飞前45分钟到达机场柜台办理报到。航空公司对于旅客因迟到而无法登机者不负任何责任。 六、 贵客于启程前应备妥出国及前往他国所需要之各项必备文件,如有效之护照,签证,防疫及其它文件。若贵客未备妥前项文件而导致任何损失或费用,航空公司不负赔偿责任。 乘客须知 贵客行程之停留地或目的地如在起程国境外者,得适用华沙公约。该公约系规定并在多数场合限制运送人对乘客死亡受伤及行李灭失损害之赔偿责任(请参阅「对国际线乘客有关赔偿责任限额之通告」及「行李赔偿限额之通告」)。 契约条款 一、本契约所称「客票」系指本客票及行李票或使用电子机票时则为旅客行程表及收据(本契约条款及乘客须知为其一部份),所称「运送」即系运输,所称「运送人」系指依据本契约运送或承运乘客或行李或担任附带于此项空运之其它服务工作之航空运送人,”电子机票”是指航空公司或其代理人所开发的旅客行程表/收据、电子票联及可适用于登机之文件。所称「华沙公约」系指一九二九年十月十二日在华沙签订之国际空运统一规章公约或指一九五五年九月二十八日在海牙所修订之该项公约。 二、依据本契约之运送,受华沙公约所定有关责任之规定及限制之约束,惟不属该公约所称「国际运送」者除外。 三、在不抵触前项规定之范围内每一运送人担任之运送或其它服务,应受下列之拘束: (一) 本客票所载各项规定 (二) 适用之运价准则 (三) 除出入美国或加拿大国境之运送应依在各该国有效之运价准则办理外,运送人之运送条款及有关规章,概作为本契约之一部份,并在运送人各办事处随时备供查阅。 四、运送人之名称在客票上可用简称,而运价准则、运送条款、规章或时间表内均列有运送人之全名及简称,运送人之地址应为客票上首列运送人简称处所列之起飞航空站,约定之停留地即系本客票所列之停留地或运送人时间表所载属于乘客航程内之预定停留地,依本契约之运送如系由数运送人相继完成者应视为单一之运送行为。 五、航空运送人签发在另一航空运送人航在线运送之客票及行李票,仅以后者之代理人身份为之。 六、运送人责任如有任何豁免或限制,应亦适用于其代理人、受雇人及代表人,以及以飞机供应运送人使用者暨其代理人、受雇人及代表人。 七、经签收承运之行李应交付与行李票持票人。如行李于国际运输过程中受有损害应于损害发觉后即以书面向运送人提出申诉并应至迟于收到后七日内为之;如有迟延,应于行李交付之日起二十一日内提出申诉。并请参阅关于非国际运送之运价准则或条款。 八、除客票或运送人之运价准则、运送条款或有关规章另有规定外,本客票自签发日起一年内有效,依本契约运送之运费,在起运前得予变更,适用之运费如未付清,运送人得拒绝运输。 九、运送人对乘客及行李当尽其所能予以适切迅速承运,时间表或他处所列时间并非保证时间,亦不属本契约之一部份,运送人于必要时得不经事先通知,改由其它运送人或飞机代运,并得变更或取消客票所列停留地,时间表之变更无须事前通知,运送人亦不负责换接班机。 十、乘客应遵守政府一切旅行规定,出示出入境及其它必要证明文件,并在运送规定时间内到达机场。倘未规定时间,乘客亦应早到机,场俾有充份时间完成出境手续。 十一、运送人之代理人、受雇人或代表人对本契约人任何条款均无权改变、修订或舍弃。 对国际线乘客有关赔偿责任限额之通知 乘客行程目的地或中途停留地系在出发地国以外之其它国家时,华沙公约之规定或可能适用于其全部行程,包括出发地国或目的地国国境内之航段在内。如乘客之行程系来自或前往美国,或该行程中之约定停留地系在美国境内者,该公约以及适用之运送规章中所含之特别运送契约规定,加入该特别契约之航空公司对于乘客死亡或身体受伤之赔偿责任,在大多数情形下,以经证实之损害为限,每一乘客不超过美金七万五千元。此项限额以内之赔偿责任,并不以航空公司之过失为依据。如乘客搭乘之航空公司非加入上述特别契约者,或乘客之行程非来自或前往美国或该行程中之约定停留地非在美国境内者,航空公司对于乘客死亡或身体受伤之赔偿责任,在大多数情形下每一乘客以大约美金一万元或二万元为限。加入上述特别契约之航空公司名册,在该等航空公司之售票处均有存置,可向其要求查阅。 如欲获得额外保障,通常可向一般保险公司购买保险,该项保险不受华沙公约或上述特别契约所定航空公司赔偿限额之影响。详细资料,请洽询贵客搭乘之航空公司或保险公司之代表。 附注:上述美金七万五千元之赔偿责任限额系包括各种法律费用在内。惟如提出赔偿请求之所在地国规定法律费用应另行计付者,则该限额应为美金五万八千元,不包含法律费用在内。 政府征收之税捐与费用须知 本机票价格包含政府机关对航空运送所征收之税捐与费用。上述代表航空旅游相当部份成本之税捐与费用,得涵盖于票价内或在本机票税捐栏项分别表示。贵客亦得被要求给付尚未收取之税捐与费用。 行李赔偿限额之通告 航空公司对于行李之失落、迟到或损害之赔偿责任,除乘客预先申报较高之价值并预付额外之保值费用外,皆设有赔偿限额。对大多数之国际旅程言(包括国际旅程中之国内部份),托运行李之赔偿限额约为每磅美金玖元柒分(每公斤美金贰拾元);随身行李之赔偿限额为每位乘客美金肆百元。对于全部旅程均在美国境内各点之间者,有关法令规定航空公司之赔偿限额为每位乘客不得低于美金参仟元。若干种类之物品得申报超值价值。若干航空公司对于易损、贵重或易腐物品不负赔偿责任。通常行李延迟多由于转机作业疏失造成,您的行李多数会由下一班机运抵目的地,并在合理的状况下,于抵达机场后的24小时内安排免费运至府上,您亦可亲自至机场提领。详细资料,请向航空公司洽询。 机位不足通告 机位不足-被拒绝登机:针对被拒绝登机补偿办法或规则具有效力的若干国家,航空公司对因机位不足致持有确认订位之旅客被拒绝登机时,均可依相关补偿办法办理。该补偿办法之详细内容,可向航空公司之申诉单位洽询。 为减少「已订位而未搭机的旅客」造成机位空置的影响,除提供机位予其它欲搭乘此一班次的旅客,航空公司得充分利用航班之机位。航空公司尽力提供旅客已确认之机位,但仍应以现场状况而定(如旅客报到状况、气候及机型异动),以维持航空公司合理之收益。
IMPORTANT NOTICE 1. You are requested to examine your tickets, particularly the clauses of the conditions of contract and notices. 2. In case the rules and limitation of the Warsaw Convention are not applicable to the passenger's journey, then the “Civil Aviation Law” and the “Rules Governing the Compensation for the Damages Sustained by Passengers and Cargo Carried by Air “of the Taiwan Regions shall govern. The liability of the carrier is limited to: TWD 3,000,000 for death of the passenger; TWD 1,500,000 for serious injury to the passenger; a maximum of TWD 1,500,000, according to the extent of damage, for injuries other than death of or serious injury to the passenger. The liability of the carrier is based on the actual damage for checked baggage subject to a maximum of TWD 1,000 per kilogram, and for unchecked baggage subject to a maximum of TWD 20,000 per passenger. IF the law or regulation is changed, then the effective provisions shall prevail. 3. Flight coupons must be used in sequence from the place of departure as shown on the tickets. 4. Passengers holding special fare tickets are requested to contact your airline office or travel agent for detail of the special condition. 5. The time shown on the flight coupon is the departure time of aircraft. Please arrive at check-in counter at airport at lease 45 minutes before the scheduled departure time of your flight; earlier arrival will enable you to have ample time to complete a number of formalities. Flights will not be held for late-arriving passenger and carriers assume no liability for any loss incurred there from. 6. TRVAEL DOCMENTS – Passengers are reminded that it is their responsibility to obtain the necessary travel, health and other documents requires by the countries to be flown from, into or over, before the commencement of their travel, and carrier is not liable to passengers for loss or expenses due to passenger's failure to comply with such requirement. NOTICE If the passenger's journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention may be applicable and the Convention governs and in most cases limits the liability of carriers for death or personal injury and in respect of loss of or damage to baggage. See also notices headed “Advice to International Passengers on Limitation of Liability” and “Notice of Baggage Liability Limitations”. CONDITION OF CONTRACT 1. As used in this contract “ticket” means this passenger ticket and baggage check or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions and the notices form part, “carriage” is equivalent to “transportation”; “carrier” means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, “electronic ticket” means the Itinerary/Receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document. “Warsaw Convention” means the Convention for the Unification of Certain Rules relating to international Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at the Hague, 28th September 1955, whichever may be applicable. 2. Carriage hereunder is subject to the rule and limitations relating to liability established by the Warsaw Convention unless such carriage is not “international carriage” as defined by that Convention. 3. To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (i)provisions contained in the ticket;(ii)applicable tariffs;(iii)carrier's conditions of carriage and related regulation which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply. 4. Carrier name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier's tariffs, condition of carriage, regulations or timetables; carrier's address shall be the airport of departure shown opposite the first abbreviation of carrier's name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier timetables as scheduled stopping places on the passenger's route; carriage to be performed hereunder by several successive carriers is regarded as a single operation. 5. An air carrier issuing a ticket for carriage over the lines of anther air carrier does so only as its Agent. 6. An exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and person whose aircraft is used by carrier for carriage and its agents, servants and representatives. 7. Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage regarding non-international transportation. 8. This ticket is good for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier tariffs, conditions of carriage, or relates regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid. 9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetable or elsewhere are not guaranteed and from no part of this contract. Carrier may without notice substitute alternate carrier or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections. 10..Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed early enough to complete departure procedures. 11.No agent, servant or representative of carrier has authority to alter modify or waive any provision of this contract. ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY Passenger on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. For such passenger on a journey to, from or with an agreed stopping place in the United Stated of America, the convention and special contracts of carriage embodied in applicable tariffs provide that the liability of certain carriers, parties to such special contracts, for death of personal injury to passenger is limited in most cases to proven damages not to exceed US$75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of the carrier. For such passengers traveling by carrier not a party to such special contracts or on a journey not to , from, or having an agreed stopping place in the United Stated of America, liability of the carrier for death or personal injury to passengers is limited in most cases to approximately US$10,000 or US$20,000. The names of carriers, parties to such special contract, are available at all ticket office of such carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier's liability under the Warsaw Convention or such special contracts of carrier. For further information please consult your airline or insurance company representative. Note:The limit of liability of US$75,000 above is inclusive of legal fees and costs except that in case of a claim brought in a state where provision is made for separate award of legal fees and cost, the limit shall be the sum of US$58,000 exclusive of legal fees and costs. NOTICE OF GOVERNMENT IMPOSED TAXES, FEES AND CHARGES The price of this ticket may include taxes, fees and charges which are imposed on air transportation by government authorities. They may represent a significant portion of the cost of air travel and are either included in the fare, or shown separately in the “TAX/FEE/CHARGE” box (es) of this ticket. You may also be required to pay taxes or fees or charges not already collected. NOTICE OF BAGGAGE LIABILITY LIMATATIONS Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys)the liability limits is approximately US$9.07 per pound (US$20.00 per kilo)for checked baggage and US$400.00 per passenger for unchecked baggage. For travel wholly between U.S. points, Federal rules require any limit on an airline's baggage liability to be at least US$3,000 per passenger. Excess valuation may be declared on certain types of articles. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier. Notice of flight overbooking DENIED BOARDING BY OVERBOOKING In those countries where Denied Boarding Compensation regulations are in force, carriers operate compensations plans for passengers with confirmed reservations who are denied boarding because of non-availability of seats caused by overbooking. Details of these plans are available at the airline's offices. In order to minimize the effect of no-shows and to permit seats to be used by passengers who otherwise would not be able to travel on a chosen flight, carriers may overbook flights. Whilst carriers make every effort to provide seats for which confirmed reservations exist, seat availability is not absolutely guaranteed.
